Terms and Conditions of Frame/Pedestal Sale
PACKAGING INFORMATION
All items are bulk packaged for shipment. If you have specific packaging requirements they must be quote separately.
INSPECTION BY BUYER
It is imperative that shipments be inspected upon receipt of damage. ANY indications of damage MUST BE written on the delivery receipt which you sign when the order is delivered. Any shortages of items must also be recorded. If you sign that a shipment is received without damage, you will be responsible for replacement/repair costs of the product and additional freight charges. If concealed damage is found on an order which has been received as “clear” upon delivery, you have seven(7) days, from the date of delivery to report this damage to us. You will be responsible for the replacement/repair costs of products reported after seven (7) days, as well as additional shipping charges. If damage has occurred, you must retain the packaging for the freight hauler auditors to inspect. Photographs of the damage is also required for us to submit claims to the freight company.
SHIPMENT INFORMATION
Shipments are shipped either by LTL truck/UPS or Fed Ex. All freight quotes given during the bid process are good for 30 days unless stated otherwise. The Buyer will be responsible for any additional shipping requirements not revealed at the time of order and will be invoiced accordingly. Some additional charges are listed below:

If your order is delivered by truck, be aware that it may be on a 4’ or 8’ pallet and may require you to request a lift gate if you do not have a loading dock or a forklift. The customer is responsible for removing the items from the LTL truck unless they have requested a lift gate for delivery. Often times fork trucks are also required for removing the items from the lift gate and are the responsibility of the customer.
TERMS OF PAYMENT
Payment terms are listed on Sellers cost proposal and invoice. Payment must be made for the Products regardless of whether Buyer has made, or plans to make, any inspection of the Products. Seller reserves the right to apply new funds to past due balances. Seller reserves the right to change agreed to payment terms at any time. To the extent permitted by applicable law, Seller shall have the right to be reimbursed for all its costs and expenses in collecting overdue payments. These costs and expenses shall include, but not be limited to, legal fees (including reasonable attorney fees), court filing fees, process server fees, interest on the debt at the maximum rate allowable by law and storage fees.
NON-CANCELABLE / NON-RETURNABLE PRODUCTS
The Buyer agrees that orders may not be cancelled, returned or rescheduled by the Buyer without the written agreement of Seller. It is further understood by the Buyer, that should Seller authorize a cancellation or return, that depending on the work that has been completed, Buyer may be obligated for charges up to the total of the entire order.
LIMITED WARRANTY
It is the sole and exclusive responsibility of Buyer to determine the suitability of any and all products of Seller for Buyer’s intended purposes and uses. Seller warrants that the products sold hereunder conform to Seller’s applicable specifications for such products. Seller shall not have any liability whatsoever for any damage to or defect in products resulting directly or indirectly from events occurring after the delivery of such products to carrier by Seller.
